Terms and Conditions 

  1. Terms: All shipments are C.O.D. or payment in advance. We do not have open accounts. We accept wire transfers or advance payments.

If for some unexpected reason we are unable to get check on delivery, and we choose to leave the material, buyer agrees to mail a check the next business day. A service charge of 1.5% per month will be charged for invoices not paid within 10 days. Customer agrees to pay a service fee of $25 for returned checks. Customer agrees to pay any and all collection expenses, including attorney’s fees and court costs, should they be necessary to effect the collection of an account. By ordering from us, buyer agrees to these terms. 

  1. Delivery: All orders are F.O.B. at our Miami, FL nursery. Truck deliveries to many, but not all, areas of South Florida are available by our trucks or a local trucking service at $1.50 per tray with a $35 minimum delivery charge. Truck deliveries of large quantities to other areas can be arranged. All orders outside our delivery area will be shipped U.P.S. Ground Service or FedEx unless other arrangements have been made. Shipment is made at the expense and risk of the purchaser. When boxing is necessary, customer will be charged $4.50 per box. Frost & specialty boxes are slightly higher. Any governmental or agricultural  inspections or fees will be at the customer’s expense.

Orders may be picked up at our nursery. Our pick up hours are 7:30 AM to 5:00 PM, Monday through Saturday. 

  1. Minimum: Two (2) trays or 100 of a variety, whichever is greater.
  1. Warranty: We warrant only to the extent of purchase price that the stock is sold as represented. Bougainvilleas.com, Inc. gives no other warranty, expressed or implied, and will in no way be liable for more than the invoice price of the material.
  1. Claims: All claims must be made upon receipt of material. Examine and count all material upon receipt and note any problems on the bill of lading/invoice. Shipments, when delivered to carrier, become consignee’s property. Claims for damages during transportation must be filed by customer with the carrier. No claims for damage or shortage will be honored unless it is reported to us upon receipt of goods, and written notice given within 10 days.
  1. Prices: All prices are F.O.B. our Miami, FL nursery and are subject to change without notice. This price list is effective January 1, 2002 and supersedes all previous listings.
